AIS-140 Mandatory States & Vehicle Categories: What's Changing
Which states currently enforce AIS-140, and how the rollout is expanding to new vehicle categories.
AIS-140 didn't roll out everywhere on the same day, for the same vehicles. It's been a state-by-state process, and it's still moving — new categories get added, enforcement gets stricter as RTOs tighten permit checks, and rules that were loosely enforced in one state can be strictly enforced in the neighbouring one. If you operate across state lines, that inconsistency is the actual problem, not the standard itself.
Why coverage isn't uniform
AIS-140 is a national technical standard, but enforcement is a state transport department matter — each state decides when and how strictly to require certified VLTD fitment as a condition of permits and fitness certificates. That's why you'll hear different answers depending on who you ask and where their fleet operates.
The pattern so far has generally moved from a narrower starting point — public buses and cabs — outward to cover more categories, including staff transport and, in several states, goods carriers above certain weight classes. Expect that direction of travel to continue rather than reverse.
What tends to trigger a compliance check
In practice, most fleet owners discover a gap at one of three moments: registering a new vehicle, renewing a permit, or renewing a fitness certificate. RTOs increasingly treat VLTD fitment as a checklist item at these touchpoints rather than something enforced through roadside checks — which means the risk isn't a fine on the highway, it's a stalled renewal at the counter.
What this means if you run a multi-state fleet
Don't assume the rules that applied when you registered a vehicle two years ago still describe the full picture, and don't assume what's true in one state is true in the state next door. If your fleet crosses state lines or you're planning to register new vehicles, the only reliable move is to check current requirements per vehicle category and registration state before you're standing at the RTO counter.
